Official Contest Rules
1. CONTEST SUMMARY. The Great Gear Makeover (the "Contest") is sponsored by A.L.S. Enterprises, Inc. d/b/a Scent-Lok®, a Michigan corporation, of 1731 Wierengo Drive, Muskegon, Michigan USA 49442 ("Scent-Lok"). These are the official rules (the "Official Rules") for the Contest. As part of the Contest, Scent-Lok is seeking photo entries from customers to determine who will win a Scent-Lok Hunting Gear Makeover. The grand prize winner will win a Scent-Lok Hunting Gear Makeover. A panel of judges will review all entries and decide in their sole discretion the grand prize winner based upon the entry that has the most unique, humorous or outdated hunting wardrobe. In addition, one (1) winner per month will be randomly selected from among all entries received from July 15, 2010 through December 1, 2010 and will comprise the monthly prize package winners. Winners will be selected from entries wearing hunting gear.
2. ELIGIBILITY; NO PURCHASE NECESSARY. The Contest is open only to individuals, 18 years or older at time of entry, who are legal residents of the 50 United States and Washington, D.C. (excluding, without limitation, such residents if located in an overseas military installation, Puerto Rico and other U.S. Territories) (an "Entrant"). The Contest begins at 12:00 a.m. ET on July 15, 2010 and ends at 11:59 p.m. ET on December 1, 2010. For purposes of the Contest and the Official Rules, all times are Eastern Time (ET). Employees of Scent-Lok and its parent companies, subsidiaries, affiliates or agents, and their immediate families are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, municipal, and local laws and regulations. Void where prohibited by law. No purchase necessary; a purchase or payment of any kind will not increase your chances of winning. PARTICIPATION CONSTITUTES ENTRANT'S FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFICIAL RULES AND SCENT-LOK'S DECISIONS, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST.
3. ENTRY. There are two ways to enter the Contest. Individuals wishing to enter the Contest may:
(a) Register online at ScentLok.com and click on the link for the Contest and follow the instructions to enter the Contest and submit photos online. Online Entrants will be asked to provide their name, complete physical address, e-mail address, daytime phone number, birth date, and gender.
or,
(b) Visit a participating Scent-Lok retailer and enter by completing an official entry form (while supplies last). Entrant will provide a photo of the individual in his/her outdated hunting wardrobe. Entrants may also hand print their name, complete physical address, e-mail address, daytime phone number, birth date, and gender on a 3" x 5" piece of paper and mail it along with a photo (no larger than 4" x 6") to Scent-Lok Technologies, Attn: Great Gear Makeover, 1731 Wierengo Drive, Muskegon, MI 49442 by close of business on December 1, 2010;
Entries must be completed in full with all required information to be eligible. Online entries must be received by 11:59 pm ET on December 1, 2010. LIMIT ONE (1) ENTRY PER PERSON (REGARDLESS OF WHETHER ONE PERSON HAS MORE THAN ONE E-MAIL ADDRESS) OR E-MAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME E-MAIL ADDRESS) OR MAILING ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME MAILING ADDRESS).
4. GENERAL RULES AND LIMITATIONS.
(a) Scent-Lok is not responsible for technical, server, hardware or software failures, or other errors or problems which may occur in connection with the Contest, including, without limitation, interrupted or unavailable network, server or other connections, miscommunications, or technical failures, or other errors of any kind, whether human, mechanical or electronic errors or problems which may occur in connection with the administration of the Contest, the processing of entries, that may limit Entrant's ability to enter the Contest.
(b) As permitted by law, Scent-Lok may use information provided by Entrants to send announcements about Scent-Lok's products and programs via electronic and ordinary mail.
(c) Scent-Lok reserves the right to cancel, suspend and/or modify the Contest, or any part of it, at any time for any reason. In such event, the prize winners may be selected by random drawing from all eligible entries received up to the time of such cancellation, termination or suspension if such a drawing is held.
(d) The Contest is intended to be a fun and safe event. Scent-Lok reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Scent-Lok reserves the right to seek damages from any such person to the fullest extent permitted by law.
(e) All information provided by Entrant must be complete, true and correct. All submitted entries become the property of Scent-Lok and will not be acknowledged or returned. Scent-Lok is not responsible for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected entries. By entering, you agree to be bound by these Official Rules.
(f) Any prize returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited and awarded to an alternate winner. Alternatively, if a potential winner does not respond to an e-mail notification within five (5) days of its transmission, or should an e-mail, after up to three (3) attempts, be returned as undeliverable, the potential winner will be disqualified and an alternate winner will be selected.
(g) Scent-Lok will not replace any lost or stolen prizes. Each prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
5. PRIZES; WINNER SELECTION; ODDS OF WINNING; APPROXIMATE RETAIL VALUE.
(a) A total of six (6) randomly chosen entries will win monthly prizes consisting of a Scent-Lok outfit consisting of either Savanna, Full Season, or Ladies Series Jacket, Pant and Headcover. One (1) winner per month will be randomly selected from among all entries received from July 15, 2010 through December 1, 2010 and will comprise the monthly prize package winners. Monthly drawings will be conducted on or about July 31, 2010, August 31, 2010, September 30, 2010, October 31, 2010, November 30, 2010 and December 31, 2010 by Scent-Lok. The approximate retail value of each monthly prize package is $350.00. Monthly prize winners will continue to be eligible to win the grand prize, but will not be eligible to win more than one monthly prize.
(b) A panel of judges will select one (1) grand prize winner to receive a the complete line of Scent-Lok® gear. Each grand prize winner will also receive a pair of Danner® Pronghorn boots and a Hunter Safety System® harness. The approximate retail value of the grand prize package is over $3000.00.
(c) In case of a dispute as to the identity of a winner that entered online, such entry will be declared made by the registered user of the e-mail account, and if a prize is won, and such registered user has submitted a valid entry, the prize will be awarded to such registered user.
(d) By participating, Entrants agree to these Official Rules and the decisions of Scent-Lok. Scent-Lok's decisions as to the administration and operation of the Contest and the selection of potential winners are final and binding in all matters related to the Contest. Winners will be notified via phone and/or mail on or about the date of the prize drawing. Odds of winning depend on the number of eligible entries received. Scent-Lok's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
(e) All winners will be required to sign and return an affidavit of eligibility, a liability release and waiver, a publicity release, and W-9 form within five (5) days of the date printed on the prize notification.
6. PRIZES NOT TRANSFERABLE; TAXES. Prizes are not transferable in whole or in part redeemable for cash or exchangeable for any other prize, except that Scent-Lok reserves the right to substitute a prize of equal or greater value for any reason. Each winner is solely responsible for reporting and paying any and all applicable federal, state or local taxes associated with the receipt of any prize. Each winner must provide Scent-Lok with a valid taxpayer identification number or social security number before any prize will be awarded. Each winner may receive an IRS Form 1099 declaring the value of the prize won by such party.
7. LIMITATIONS OF LIABILITY; RELEASE. By participating in the Contest, Entrants agree to indemnify and hold harmless Scent-Lok and its parent companies, affiliates, subsidiaries, employees, directors, officers, shareholders, and agents and each such company's directors, officers, shareholders, and agents from and against any and all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the Contest, or acceptance, use, or misuse of any prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages.
8. PUBLICITY. Except as otherwise prohibited by law, by entering the Contest, each Entrant grants permission to Scent-Lok to use his/her name, address, likeness, photograph, and statements to Scent-Lok and its successor companies, affiliates, subsidiaries, and advertising/promotional agencies for advertising/publicity purposes in any and all media, worldwide in perpetuity without further compensation.
9. PRIVACY. By participating in the Contest, Entrant acknowledges and agrees that Scent-Lok may collect personal information submitted by Entrant, and use the information pursuant to Scent-Lok's privacy policy available by clicking on the privacy policy link at ScentLok.com.
10. DISPUTE RESOLUTION. Except where prohibited by applicable law, by entering you agree that: (a) any and all issues, disputes, claims and causes of action arising out of or connected with the Contest, these Official Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Michigan or the appropriate Michigan State Court located in Kent County, Michigan, and Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (d) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Scent-Lok in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any other jurisdiction.
11. WINNER'S LIST. For the identity of the winners, send a self-addressed, stamped envelope after December 31, 2010 to "Contest Winners" at the Scent-Lok address listed above.

(EXCLUDING, WITHOUT LIMITATION, SUCH RESIDENTS IF LOCATED IN AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO AND OTHER U.S. TERRITORIES. DO NOT ENTER THE CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF THE UNITED STATES OR IF YOU ARE LOCATED ON AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, ANY OTHER U.S. TERRITORY OR ANY FOREIGN COUNTRY OR TERRITORY.
